Can the ISBA take a lesson here ?

GAL Reform Senate Bill Passed out of Judiciary Committee unanimously last night!

The party is coming to an end for those GALs/AMCs who have abused a system that was intended to only help children and families. They know who they are and it does include Judges such as Munro and Boland who have used their “discretionary” power to unilaterally increase the GAL fees when they felt it wasn’t “fair to the GAL” to receive fees less than counsel for the parents or because the GAL has a JD and masters degree. YES this has happened! Not to mention Judges who have taken it upon themselves to subject parents to 10% interest on GAL fees if a balance remains after a certain date.

There’s so many more examples and if you review my testimony online that I submitted, you will see many examples of the egregious decisions and acts made by GALS and Judges on many cases that could never lead to the best interest of our children. When we mention Judges working in the capacity of a collection agency for GALs, I find it extremely disturbing that an active GAL who not only runs the GAL program and is the treasurer of the CT chapter of the AFCC, was sitting in the public hearing snickering at testimony while according to public records, he allegedly has hundreds of thousands of dollars of tax liens on his $500,000 Guilford property from the State of Connecticut and the IRS. The above information has been obtain through public records and if anyone would like backup to this information please let me know.

The Judiciary Committee meeting held yesterday, which some have seen in parts is now on CT-N and I believe everyone will be satisfied with the passion and dedication for change expressed in this meeting. It’s extremely compelling especially Senator Kissel’s speech. Like I said, the party is over and you ALL should be very proud of yourselves! This is democracy and justice. Like I have said many times, our children deserve better; and parents, absent abuse and neglect have the constitutional right to parent their children without government interference.

I would like to request a very important task for those able to help. If the Judicial Branch can’t provide data in order for us to study the number of GALS on cases, then I have found a way to obtain this information without leaving our homes. Thus far, the data i was able to collect from only April 7th is very compelling so here’s what we need to do:

1. We will go to each short calendar list for each courthouse
2. We will look at each family case listed on the short calendar for a motion for a GAL or AMC
3. Look for any case in which there’s an “O” listed which stands for OTHER – this is a new system to identify GALs, AMCs, Children’s LAW Center and alike besides a parent’s counsel
4. Look at the docket number which will begin with 101.00 meaning the first motion filed. When you see 103.00 and it’s a motion for a GAL, then CLEARLY all other resources were not exhausted before introducing a GAL into the case as Judge Solomon testified to at the public hearing.
5. Next, if you can’t seem to determine if one of the attorneys listed is a GAL or AMC, look up the case and it will identify the GAL and to the right of their listing, the date in which they were appointed.

The task is simple to do once you get going but it takes time. We can create an excel spreadsheet and add our data to it. For those who have the time and can dedicate to working on this with me, let’s have a phone conversation to go through some of the other things I need to point out to you before you begin. The first Judicial Districts to begin with will be Fairfield/Bridgeport, Stamford, New Haven and Hartford.

Trust me on this; this is how we collect the data the Judicial Branch can’t seem to provide and it will 100% contradict that this problem is 3% or 10% or whatever percentage our critics choose to claim on any given day. People lie but numbers do not. I will create the excel spreadsheet today.
